Agreement to these terms

These Terms of Use (“Terms”) are a legal agreement between you and CourtRoster (“CourtRoster,” “we,” “us,” or “our”) governing your use of our websites, mobile applications, and related services (collectively, the “Service”). By accessing or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Eligibility and authority

You must be at least 13 years old to create an account. If you are under the age of legal majority where you live, a parent or legal guardian must review and agree to these Terms on your behalf. The Service is not intended for children under 13.

If you use the Service for a club, league, team, company, or other organization, you represent that you have authority to bind that organization, and “you” includes the organization.

Accounts and security

You agree to provide accurate information, keep it current, protect your credentials and private access links, and promptly notify us of suspected unauthorized use. You are responsible for activity through your account and for ensuring that your use complies with these Terms.

You may sign in through third-party providers such as Google or Apple. Your use of those services is also governed by their terms. We may reject registrations, reclaim usernames, or require you to change account information that is inaccurate, misleading, or infringes another’s rights.

Teams, roles, and roster information

Team administrators control team membership, roles, roster information, schedules, lineups, announcements, and other team content. Their actions may affect what members can see or do. CourtRoster does not select team members, determine playing eligibility, or make lineup decisions.

If you add another person’s name, email, phone number, location, rating, USTA identifier, photo, or other information, you represent that you have a lawful basis and appropriate permission to provide it and use it for team administration and communications. You must use reasonable care with invitations, availability requests, and confirmation links, which may allow the holder to view or submit limited team information.

Communications and notification choices

The Service helps teams send operational messages by email, SMS, push, and in-app notification. By providing contact information and enabling a channel, you consent to receive messages related to accounts, teams, invitations, schedules, availability, lineups, announcements, and results. Message and data rates may apply. Message frequency varies.

You can manage optional notification channels in your profile or follow opt-out instructions in a message. Consent to receive optional text messages is not a condition of purchase. We may still send essential security, account, or service notices where permitted by law.

Acceptable use

You may not use the Service to:

  • violate law, another person’s rights, league rules, or contractual obligations;
  • harass, threaten, impersonate, defame, exploit, or discriminate against others;
  • upload unlawful, infringing, deceptive, malicious, or privacy-invasive content;
  • send spam or contact people without the consent required by law;
  • access another account or team without authorization, share private links improperly, or bypass access controls;
  • probe, disrupt, overload, reverse engineer, scrape, or introduce harmful code into the Service, except where applicable law expressly permits;
  • use automated means to access the Service without our written permission or use the Service to build a competing product.

We may investigate violations and remove content, restrict features, or suspend access when reasonably necessary to protect the Service or its users.

Your content

You retain ownership of content you submit to the Service. You grant CourtRoster a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify for technical formatting, display, transmit, and otherwise use that content only as needed to operate, secure, improve, and provide the Service and fulfill your requests. This license lasts for as long as the content is stored in the Service, subject to reasonable backup and legal retention periods.

You represent that you have all rights needed to submit the content and grant this license. You are responsible for your content, including its accuracy, legality, and the consequences of sharing it with a team or through an access link. We may remove content that violates these Terms or applicable law.

CourtRoster’s service and intellectual property

The Service, including its software, design, branding, text, graphics, and other materials supplied by CourtRoster, is owned by CourtRoster or its licensors and protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable right to use the Service for its intended purpose. No other rights are granted.

Third-party services and data

The Service may connect to or rely on third-party services and information, including Google, Apple, USTA, maps, app stores, notification providers, and links supplied by users. We do not control third-party services and are not responsible for their availability, accuracy, terms, privacy practices, or content. USTA and other imported data may be incomplete, delayed, or inaccurate; you should verify important schedule, eligibility, rating, and score information with the official source.

Fees and changes to the Service

Some features may be free, offered as a trial, or require payment. If we offer a paid feature, its price, billing period, renewal terms, and cancellation options will be disclosed before purchase. App-store purchases are also subject to the applicable store’s billing terms.

We may add, change, suspend, or discontinue features. Where reasonably practical, we will provide notice of a material change that significantly reduces a paid feature during its current billing period.

Suspension and termination

You may stop using the Service at any time and may request account deletion through our support form. We may suspend or terminate access, remove content, or limit features if you violate these Terms, create risk or legal exposure, fail to pay applicable fees, or if we discontinue the Service. Where appropriate, we will give notice and an opportunity to address the issue. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnity, and dispute provisions.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” COURTROSTER DISCLAIMS ALL EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT TEAM, LEAGUE, LOCATION, SCHEDULE, LINEUP, RATING, OR RESULT INFORMATION WILL BE ACCURATE. COURTROSTER IS A TEAM-ORGANIZATION TOOL AND IS NOT RESPONSIBLE FOR MATCH PARTICIPATION, ATHLETIC ACTIVITY, VENUE CONDITIONS, INJURY, OR THE CONDUCT OF USERS OR THIRD PARTIES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE TERMS MAY NOT APPLY TO YOU.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COURTROSTER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID COURTROSTER FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. APPLICABLE LAW MAY NOT ALLOW SOME LIMITATIONS, IN WHICH CASE THEY APPLY ONLY TO THE EXTENT PERMITTED.

Indemnity

To the extent permitted by law, you will defend, indemnify, and hold harmless CourtRoster and its affiliates, officers, employees, and agents from claims, losses, liabilities, damages, costs, and reasonable attorneys’ fees arising from your content, your administration of a team, your use of another person’s information, your violation of these Terms or law, or your infringement of another person’s rights. This obligation does not apply to the extent a claim results from CourtRoster’s own unlawful conduct.

Governing law and disputes

These Terms are governed by the laws applicable where CourtRoster is established, without regard to conflict-of-law principles, except where the law where you live requires otherwise. Before filing a formal claim, you and CourtRoster agree to try in good faith for 30 days to resolve the dispute informally after written notice. Any dispute not resolved informally may be brought in a court with lawful jurisdiction. Nothing in these Terms prevents either party from seeking urgent injunctive relief or using an eligible small-claims process.

General terms

These Terms and the Privacy Policy are the entire agreement between you and CourtRoster regarding the Service unless separate written terms apply. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, financing, merger, acquisition, or transfer of the Service. Headings are for convenience only.

Changes and contact

We may update these Terms. We will post the revised version, update the effective date, and provide additional notice of material changes when required. Changes apply prospectively. If you continue using the Service after revised Terms take effect, you agree to them.
